Section 363 of the Building Act identifies that a building open to the public must have a Code Compliance Certificate or Certificate for Public Use prior to being open to the public. If a building is accessible without this certification Council is likely to take enforcement action to protect public safety.

What are public premises?

Any building that is open to the public whether it’s for free or for a payment, this includes:

• shopping malls
• cinemas
• marae
• camping grounds
• visitor accommodation garages and workshops
• funeral homes
• office and retail complexes, and
• rest homes
